Finally some good news regarding home defense in Canada, on March 17th a Vaughan home was broken into by three armed intruders. The home owner had a legally stored firearm, and discharged it at the intruders and hit one of them causing them to retreat. The person hit was found 3 hours later in a hospital with a gunshot wound.

What is nice about this story is that the homeowner was not charged because he was licensed and had a legally stored firearm. This is a refreshing change of pace because usually the home owner gets charged for negligence because usually they argue there was "no threat" to the home owners life.

My question is, should home owners be allowed to discharge firearms to anyone entering their homes even if they are not armed, because there is no reason for someone to enter someone else's house unless they have ill intent. Personally I think that it would be nice to not have the threat of going to jail for defending yourself, within of course.

I get why this feels like “good news,” but I think we gotta be careful with how far we take it. There’s a big difference between defending yourself from armed intruders and saying anyone can be shot just for entering.
Yeah but like… who is breaking into someone’s house with good intentions? I feel like that’s kinda the point Kameron is making.
 
I mean, there are rare situations though. Like someone confused, intoxicated, or even just at the wrong house. It’s unlikely, but not impossible.
Exactly 😭 imagine someone goes to the wrong address and just gets shot, that’s kinda insane if you think about it

I think that's a bad argument in my opinion, because everyone locks their doors at night. If you end up in the wrong house when doors and windows are locked there is no excuse for it. I just think because usually home invasions happen at night with limited visibility, if a home owner is threatened by the idea of going to jail with life they might overthink defending themselves and could end up getting hurt by the people who have already broken the law.

I think the law has to stay case-by-case. The reason this situation worked out legally is because there was a clear threat, armed intruders. That’s very different from someone just being there.

Also intent matters a lot. You can’t always assume intent just from someone entering. That’s where it gets messy.

Yeah I get that, but at the same time if someone is entering your house without permission, you don’t exactly have time to figure out their intentions.

That’s true, but that’s why laws usually focus on “reasonable force.” It’s not about guessing perfectly, it’s about what a reasonable person would do in that situation.

But “reasonable” is kinda subjective though. That’s where people get screwed over sometimes.

Yeah I agree with this, because if you have a 5 foot 2 woman being charged by a 6 foot 3 man, is it reasonable force to discharge your weapon? But now what if its a 6 foot 3 man being charged by a 5 foot 2 woman (unlikely but for thought), is it still reasonable. Because in my opinion you don't know what they could be concealing but if you fire in defense and they aren't concealing anything then it's negligence.

In a lot of places, laws try to balance this by allowing self-defense when there is a perceived threat, but still investigating whether the response was proportional.

Yeah like I don’t want people hesitating in danger, but I also don’t want people just blasting first and asking questions later 💀

I agree but if the people are clearly a threat, i.e they are in your house on purpose, then I think we should be protecting home owners more than the criminals.

I agree, protecting home owners is important. We have gone way too soft on crime in recent times.
